The Martin Family Initiative(“MFI”, “us” and “our”) collects and processes your personal information in accordance with this Privacy Policy (“Policy”). MFI is committed to protecting the privacy of our donors, volunteers, members, and other stakeholders. We value your trust and recognize that maintaining this trust requires us to be transparent and accountable in how we manage and process the personal information shared with us.

This Policy governs how we use and communicate your personal information that we collect as part of our various [in-person and] virtual activities, through the MFI website located at www.themfi.ca (the “MFI Website”) and the TREES Network website located at www.treesnetwork.themfi.ca (collectively with the MFI Website, the “Websites”). We may collect your personal information directly from you or through third parties that have the right to communicate this information to us.

Please note that MFI reserves the right to update or change its privacy practices or this Policy at any time. We will notify you of any changes by posting an updated Policy on the MFI Website, and updating the effective date set out at the top of this Policy. The most current version of this Policy will govern MFI’s collection, communication and use of your personal information, and will become effective upon posting. By continuing to access the Websites after changes are made to this Policy, you agree to be bound by the revised terms. Please review this Privacy Policy periodically to see any changes to our Privacy Policy.

1. CONSENT FOR COLLECTION, USE AND COMMUNICATION OF PERSONAL INFORMATION

By providing MFI with your personal information through the Websites or any of our forms, you consent to the collection, use, and communication  of such personal information in accordance with this Policy or for the purposes identified to you at the time of the collection of the personal information. Unless permitted by law, MFI will not collect, use or communicate any of your personal information for any purposes other than those identified in this Policy or at the time of collection of your personal information.

Please review this Privacy Policy before using the Websites or providing us with your personal information through any of our forms. If you do not agree with this Privacy Policy, do not use the Website nor provide us with your personal information through our forms. By submitting any personal information to this Website or through our forms, you agree to be bound by the terms of this Privacy Policy.

Subject to legal and contractual requirements, you have the right to refuse or withdraw your consent to our collection, use or communication of your personal information at any time by contacting us in accordance with Section 12.  However, if you withdraw your consent, the withdrawal will not affect the lawfulness of any processing carried out before the date on which you withdrew your consent. Please note that revoking your consent may result in you not being able to access or utilize certain MFI features or services, including those features or services of the Websites.

2. PERSONAL INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

MFI collects, uses and communicates your personal information at all times in accordance with this Policy and applicable privacy laws.  When “personal information” is referenced in this Policy, the term is intended to mean any information about an individual from which that individual can be identified directly or indirectly.

The types of personal information that MFI may collect include:

(a)            MFI Programs Information. As part of the MFI programs described at https://www.themfi.ca/programs, MFI collects and stores personal information that you may provide to it (“MFI Programs Information”), including your name, address, school and reading level.

(b)            Identity Information. MFI may collect personal information about your identity (“Identity Information”), including your first name, last name, age, position/role in your organization, job sector, and whether you identify as First Nations, Inuit or Métis.

(c)            Contact Information. MFI may collect personal information that allows it to contact you (“Contact Information”), including your email address, home address, postal code and telephone number.

(d)            Donation Information. When you make a donation in your name, MFI collects your name and address for the purpose of processing the donation and, where applicable, issuing a tax receipt (“Donation Information”).  Financial information, including credit card information, is collected by our donations processing service provider, and handled in accordance with its privacy policy (which, is currently CanadaHelps, and whose privacy policy can be found at the following link:  https://www.canadahelps.org/en/privacy-policy/).  

(e)            Donation Recipient Information. You may also make donations in honour or in memory of someone. When doing so you may notify the individual or the individual’s family on their own, or request that MFI send a free “eCard” to the individual. In the event that you request that an eCard be sent, MFI will collect personal information about the recipient of the donation, or the family of the recipient in the case of a donation in memory (“Donation Recipient Information”), such as their name and email. We collect this personal information in order to notify the recipient of the donation through the eCard. We do not use or communicate the recipient’s personal information for any other purpose unless they give us permission to do so. We do not publish the amount of any donation made in honour or in memory.

(f)             Mailing Lists and Newsletters Information. If you sign up for an MFI newsletter, MFI will use the email information you provide to send you newsletters and other information requested. Any personal information provided by you in that context will be used for the purpose of delivering newsletters, MFI updates, and/or educational resources. You may opt out of receiving such communications at any time by contacting us as set out in Section 11 below. You may also, at any time, choose to opt-out of receiving communications from us by clicking the unsubscribe button at the bottom of each email sent from MFI to you.

(g)            TREES Network Information. When you create a user account on the TREES Network (as described in the TREES Network’s Terms of Use) and fill out the user account creation form, you accept to provide MFI certain of your personal information, including the types of personal information described in Sections 2(a) (MFI Programs Information), 2(b) (Identity Information) and 2(c) (Contact Information), above. We may also collect information on how you use the TREES Network (“Usage Data”), which may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the TREES Network pages that you visited, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. Further, certain features on the TREES Network may require the use of your location data, if you give us permission to use such location data (“Location Data”), which you can enable or disable through your device settings. Finally, some other features on the TREES Network may collect Usage Data through the use of cookies and other similar tracking technologies, which contain small amounts of data that could consist of anonymous unique identifiers, and which are sent through your brower and stored on your device. You can instruct your browser to refuse the sending of cookies. If you choose to refuse to send any cookies to the TREES Network and/or do not give us permission to use Location Data, you may not be able to use certain features of the TREES Network.

MFI does not collect any sensitive personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, and health, genetic or biometric information) or any of your financial information (including, through any donations made through our donations processing service providers through our Website).

Note that the Websites and any online recruitment service that MFI may provide through the Websites are directed to, and meant to be used by, adults or individuals no younger than the age of majority. In particular, we do not knowingly collect any personal information from any persons under the age of 14. If we become aware that we have collected any personal information from a child under the age of 14, we will delete that information. We ask parents and other guardians to monitor their children's Internet usage in order to protect them.

If you provide MFI with personal information of another individual, you represent and warrant to us that you have obtained all of the necessary consents from such individual to enable us to collect, use and communicate such personal information for the applicable purposes set forth in this Policy.

3. WHY WE COLLECT YOUR PERSONAL INFORMATION

MFI may use your personal information for the purposes for which it was collected, as described in this Policy, for other purposes when and where permitted by law, or for other purposes with your consent.

4. USE AND COMMUNICATION OF PERSONAL INFORMATION

All personal information submitted to MFI, including through MFI’s Websites or a prescribed form, is kept confidential unless communicated in accordance with your consent or legal requirements.

MFI may dislose your personal information to third parties and outside service providers (the “Third Parties”) with respect to the personal information we collect from you as described in this Policy for reporting purposes, and to deliver and execute fundraising and promotional campaigns. Those Third Parties notably may include private and public foundations that provide us with funding, web developers that support our development and management of the Websites, and communications firms that support us with our fundraising and promotional campaigns. To the extent that any personal information is provided to these outside parties, MFI requires that the provider be contractually bound by obligations consistent with this Policy and that such providers only collect, use, or communicate your personal information for the purposes described in this Policy or for which you have otherwise given consent.

Personal information provided by MFI users will not be sold, shared, or rented to outside organizations unless in accordance with your consent.

MFI reserves the right to contact you at any time using the Contact Information you provide to forward information, respond to questions, or provide notification of any changes to our programs or our policies.

MFI will communicate personal information only if consent is given by the relevant individual or:

(a) when permitted or required by law, such as in response to a subpoena or other legal process;

(b) as part of a transaction involving the transfer of all or part the control or assets of MFI;

(c) to MFI’s service providers in accordance with this Policy; or

(d) to meet legal obligations, including but not limited to regulatory reporting obligations.

MFI uses the following may communicate your personal information to the following categories of service providers:

(a) donations processing service providers to process donations made using our website and to provide tax receipts directly to our donors; and

(b) e-learning management systems service providers to provide online courses and professional development or training.

5. INTERNATIONAL TRANSFERS OF YOUR PERSONAL INFORMATION

By providing MFI with personal information, you acknowledge and agree that your personal information may be transferred to other jurisdictions for processing and storage, including in servers located in Ontario. Further, your personal information may be accessible to law enforcement, national security authorities, and the courts of such jurisdictions. If you are from Quebec, such other jurisdictions may include Canadian provinces or territories other than Quebec. Where necessary to make such transfers, we will comply with our legal and regulatory obligations in relation to the personal information. If you have any questions regarding our policies and practices relating to our storage and processing of personal information in other jurisdictions, please contact us at any time in accordance with Section 12.  

6. YOUR RIGHTS AND ACCESS

To the extent provided under applicable laws, you have the right to access personal information that MFI holds about you. Subject to the limitations set in applicable laws, you can request from us information about:

(a)            the personal information we hold about you;

(b)            the categories of personal information concerned;

(c)            the purposes of the processing;

(d)            details to whom your personal information has been/will be disclosed;

(e)            how long we retain your personal information;

(f)             if we did not collect your personal information directly from you, information about the source; and

(g)            how to lodge a complaint with the correct supervisory authority. 

You may also request from us the following:

(h)            that we provide you with the personal information you have provided us in a structured, commonly used and machine readable format and that we transfer it to a third party of your choice;

(i)             that we update any incomplete or inaccurate information about you; and

(j)             that we delete your personal information in accordance with applicable laws.

You may request we action your rights by contacting us as set out in Section 11 below. All your requests must be done in writing and MFI may require you to prove your identity in order to process your request. Note also that we reserve the right to entirely or partially refuse your request when permitted by applicable laws. MFI will provide an answer to your request within the time limits mandated by applicable laws. If we deny any request (in whole or in part), MFI will provide you with the reasons explaining our refusal and information about how to appeal our decision, in compliance with applicable laws.

7. SOCIAL MEDIA/FORUMS

If you voluntarily submit or post any information, photographs, or other content to any MFI forums, Twitter pages, Facebook pages, or other social networking pages/sites, certain elements of your personal information may be automatically included in the posting, including your user name and email address, and this information may be collected and used by others. MFI has no control over, and is not liable for, the collection, use, or disclosure of any posted user content by users of such forums and social media networking pages. For further clarity, except with regard to MFI forums hosted on the Websites, any personal information posted, used, or disclosed via such sites is not subject to this Policy.

8. LINKS TO OTHER SITES

The Websites may contain links to other sites that are operated by third parties. Please be aware that MFI does not control such websites and we are not responsible for the privacy practices of these websites. We encourage Websites visitors to be aware that when they leave the Websites, they should thoroughly read the privacy statements and applicable terms of use of each and every website that collects personal information.

9. SECURITY

MFI employs reasonable administrative and technological industry safeguards and security measures which are intended to protect our systems against unauthorized use and access to personal information. It is important to remember that no method of transmitting or storing data is completely secure. Mail, emails, voice communications, faxes, and data transmissions over the Internet are all susceptible to possible loss, misrouting, interception, and misuse of the information being communicated or transmitted. MFI does not guarantee the security of your personal information when is it transmitted over means of communications that are susceptible to any of the foregoing.

Our servers on which your personal information resides are located in Canada, and follow industry standards pertaining to security.

10. BREACH

MFI shall comply with, and provide you with reasonable assistance in complying with, applicable laws with respect to any unauthorized use, access, or communication of personal information.

11. RETENTION

MFI only retains personal information for as long as it is necessary for the purposes for which it was collected or for as long as required to comply with applicable legal obligations. When personal information is no longer required for these purposes, it is securely destroyed, deleted or anonymized in compliance with applicable laws and regulations. To review or update your personal information in MFI’s possession, request information about the collection, use or communication of your personal information by MFI  or withdraw consent to the collection, use, and/or communication of your personal information by MFI or remove your name from an email or other mail list of MFI, please contact us at:
